At HouseAllies.com we host an online community of real estate agents and vendors to allow members to foster business relationships to better serve the needs of real estate clients and homeowners (the Service).

By using this website, you are agreeing to these legally binding rules (“Terms of Use”). You’re also agreeing to our Privacy Policy and agreeing to follow any other rules on the Site.

If you do not agree to these Terms of Use, you may not use HouseAllies.com.

HouseAllies.com reserves the right to discontinue your membership at any time for any reason.

Explanation of User/Member Types:

Read-only User: Some users will come to HouseAllies.com via an email message sent from a Real Estate Member. The email may contain links to HouseAllies.com to view Vendor contact information or informational articles and videos. These users are not Members of HouseAllies.com.
Read-only Member: A user may create a Read-Only Member account in order to search for Vendors. This type of account will not be allowed to rate Vendors or post comments of any kind. Their access to the site is limited.
Vendor Member: A Member may create a Vendor Member account if their company has been recommended by a verified real estate agent or if they are a member of a Local Realtor Board. Vendor Members may post their company contact information to be searched by other Members of the site and they may participate in Forum discussions, and post informational articles and videos to help contribute to the online community and market their goods and services. Unless a Vendor Member is also a Real Estate Agent Member, they may not provide ratings or comments on other Vendor Members. No Vendor Member may provide ratings or comments on their own company.
Real Estate Agent Member: A Member may create a Real Estate Agent Member account if they have been verified as a valid real estate agent. These Members may provide ratings and comments on Vendor Member companies, participate in Forum discussions, and post informational articles and videos for their own use. They may select their favorite Vendors, articles, and videos and send this information to their real estate clients.

License

We grant you a limited, revocable, non-exclusive, non-assignable, non-sublicensable license to access HouseAllies.com in compliance with the Terms of Use; unlicensed access is unauthorized. You grant us and other HouseAllies.com members a perpetual, irrevocable, unlimited, worldwide, fully paid/sub-licensable license to use, copy, perform, display, distribute, and make derivative works from content you post.

In order to access some features of HouseAllies.com, you will have to create an HouseAllies.com account. You may never use another's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify HouseAllies.com immediately of any breach of security or unauthorized use of your account.
Although HouseAllies.com will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of HouseAllies.com or others due to such unauthorized use.
HouseAllies.com reserves the right to discontinue any aspect of our Service at any time.
You are responsible for your own actions: You are legally responsible for your contributions on HouseAllies.com, so for your own protection you should exercise caution and avoid contributing any content that may result in criminal or civil liability under any applicable laws. For clarity, applicable law includes at least the laws of the United States of America. Although we may not agree with such actions, we warn editors and contributors that authorities may seek to apply other country laws to you, including local laws where you live or where you view or edit content. HouseAllies.com and Big Tank Marketing, LLC cannot offer any protection, guarantee, immunity or indemnification.
You are legally responsible for everything that you post on this website.

Refund/Return Policy

Members may choose the duration of their paid membership (initial options are 1 month, 3 months, or 12 months.) There will be no refunds for any reason.

What you are not allowed to do

We expect all users of HouseAllies.com to behave responsibly and help keep this a safe, friendly, and professional place. We reserve the right to discontinue your access to any aspect of the Service at any time and for any reason.

You agree not to use or provide software (except for general purpose web browsers and email clients, or software expressly licensed by us) or services that interact or interoperate with HouseAllies.com, e.g. for downloading, uploading, posting, flagging, emailing, search, or mobile use. Robots, spiders, scripts, scrapers, crawlers, etc. are prohibited, as are misleading, unsolicited, unlawful, and/or spam postings/email.

You agree not to alter or modify any part of the Service.
You agree not to access Content through any technology or means other than the functionality provided by the Service itself, or other explicitly authorized means HouseAllies.com may designate.
You agree not to use the Service for any of the following commercial uses:

the sale of access to the Service;
the sale of advertising, sponsorships, or promotions placed on or within the Service or Content; or
the sale of advertising, sponsorships, or promotions on any page of an ad-enabled blog or website containing Content delivered via the Service.

You agree not to collect or harvest any personally identifiable information, including account names, from the Service, nor to use the communication systems provided by the Service (e.g., Forum comments, email) for any commercial solicitation purposes not approved by us.
Don’t break the law. Don’t take any action that infringes or violates other people’s rights, violates the law, or breaches any contract or legal duty you have toward anyone.

Don’t lie to people. Don’t post information you know is false, misleading, or inaccurate. Don’t do anything deceptive or fraudulent.
Don’t offer prohibited items. Don’t offer any goods or services that are illegal, violate any of HouseAllies.com’s policies, rules, or guidelines, or violate any applicable law, statute, ordinance, or regulation.
Don’t victimize anyone. Don’t do anything threatening, abusive, harassing, defamatory, libelous, tortious, obscene, profane, or invasive of another person’s privacy.
Don’t spam. Don’t distribute unsolicited or unauthorized advertising or promotional material, or any junk mail, spam, or chain letters. Don’t run mail lists or any kind of auto-responder or spam on or through the Site. If you choose to opt-in to our monthly home tips email service to be sent to your clients, you agree to get permission from all of your clients before opting in to this service. If we find that you have an excessive number of clients who unsubscribe from this service or report that you are spamming them, we may terminate this service and we may terminate your membership to HouseAllies.com.
Don’t harm anyone’s computer. Don’t distribute software viruses, or anything else (code, films, programs) designed to interfere with the proper function of any software, hardware, or equipment on the Site (whether it belongs to HouseAllies.com or another party).
Don’t abuse other users’ personal information. When you use HouseAllies.com you may receive information about other users, including things like their names, email addresses, and postal addresses. This information is provided for the purposes of developing working relationships between Vendors, Real Estate Agents, and their clients - don’t use it for other purposes, and don’t abuse it.
Never attempt to impersonate another user or individual, never misrepresent your affiliation with any individual or entity, and never use the username of another user with the intent to deceive.
We also need to make sure that the Site is secure and our systems function properly. So don’t do any of these things — in other words, “don’t tamper with our system.”

Don’t try to interfere with the proper workings of the Services.
Don’t bypass any measures we’ve put in place to secure the Services.
Don’t try to damage or get unauthorized access to any system, data, password, or other information, whether it belongs to HouseAllies.com or another party.
Don’t take any action that imposes an unreasonable load on our infrastructure, or on our third-party providers. (We reserve the right to determine what’s reasonable.)
Don’t take apart or reverse engineer any aspect of HouseAllies.com in an effort to access things like source code, underlying ideas, or algorithms.

Your Content - Copyright, Trademark, Trade Secrets, License, and other Proprietary Rights

As an HouseAllies.com account holder you may submit Content to the Service, including videos, articles, Vendor reviews, forum posts, and user comments. You understand that HouseAllies.com does not guarantee any confidentiality with respect to any Content you submit.
You shall be solely responsible for your own Content and the consequences of submitting and publishing your Content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content you submit; and you license to HouseAllies.com all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Service pursuant to these Terms of Service.
For clarity, you retain all of your ownership rights in your Content. However, by submitting Content to HouseAllies.com, you hereby grant HouseAllies.com a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and HouseAllies.com's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user and member of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service. The above licenses granted by you in Content you submit to the Service terminate within a commercially reasonable time after you remove or delete your Content from the Service. You understand and agree, however, that HouseAllies.com may retain, but not display, distribute, or perform, server copies of your Content that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable.
You further agree that Content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant HouseAllies.com all of the license rights granted herein.
You further agree that you will not submit to the Service any Content or other material that is contrary to the HouseAllies.com Terms of Use.
HouseAllies.com does not endorse any Content submitted to the Service by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and HouseAllies.com expressly disclaims any and all liability in connection with Content. HouseAllies.com does not permit copyright infringing activities and infringement of intellectual property rights on the Service, and HouseAllies.com will remove all Content if properly notified that such Content infringes on another's intellectual property rights. HouseAllies.com reserves the right to remove Content without prior notice.
We don’t own the stuff you post on HouseAllies.com. But when you post it, you’re giving us permission to use or copy it however we need in order to run the site, or show people what’s happening on it. (We generally just use this to promote projects and showcase our community on the website.) You’re responsible for the content you post, and you’re vouching to us that it’s all okay to use.

Indemnification

If you do something on HouseAllies.com that winds up getting us sued, you must help defend us.

If you do something that gets us sued, or break any of the promises you make in this agreement, you agree to defend, indemnify, and hold us harmless from all liabilities, claims, and expenses (including reasonable attorneys’ fees and other legal costs) that arise from or relate to your use or misuse of HouseAllies.com. Because the content posted on HouseAllies.com is community driven, all of the content that we host is provided by users like yourself, and we do not take an editorial role. This means that we generally do not monitor or edit the content of the website, and we do not take any responsibility for this content. Similarly, we do not endorse any opinions expressed via our services, and we do not represent or guarantee the truthfulness, accuracy, or reliability of any submitted community content. Instead, we simply provide access to the content that your fellow users have contributed and edited.
We do not endorse any content, company, or user on this website. We merely host this content. Disputes and Jurisdiction

We hope that no serious disagreements arise involving you, but, in the event that there is a dispute, we encourage you to seek resolution by contacting us and working with us to resolve the dispute.

However, if you seek to file a legal claim against us, you agree (1) any claim, cause of action or dispute ("Claim") arising out of or related to the TOU or your HouseAllies.com use is governed by Colorado ("CO") law regardless of your location or any conflict or choice of law principle; (2) Claims must be resolved exclusively by state or federal court in Denver, CO (except we may seek injunctive remedy anywhere); (3) to submit to personal jurisdiction of said courts; (4) any Claim must be filed by 1 year after it arose or be forever barred; (5) not to bring or take part in a class action against Big Tank Marketing, LLC or HouseAllies.com Entities; (6) (except government agencies) to indemnify Big Tank Marketing, LLC and HouseAllies.com Entities for any damage, loss, and expense (e.g. legal fees) arising from claims related to your HouseAllies.com use; (7) you are liable for Terms of Use breaches by affiliates (e.g. marketers) paid by you, directly or indirectly (e.g. through an affiliate network); and (8) to pay us for breaching or inducing others to breach the Terms of Use.

Your use of our services is at your sole risk. We are not responsible for the content, data, or actions of our Members or third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties. No advice or information, whether oral or written, obtained by you from us or through or from our services creates any warranty not expressly stated in these Terms of Use.

Any material downloaded or otherwise obtained through your use of our services is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. If any provision or part of a provision of these Terms of Use is found unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and will be enforced to the maximum extent permissible, and all other provisions of these Terms of Use will remain in full force and effect.
